With the emergence of the new coronavirus and the need for social isolation, the crisis came early for several businesses.
In the last few days, the Federal Government has announced a series of labor measures that can be adopted to alleviate the crisis in companies and B21 Import & amp; Export we summarize for you to find out and adapt.
The government’s measures to face the coronavirus crisis are temporary labor measures and were edited in a Provisional Measure. In other words, they are effective immediately, but they need approval from the National Congress in the next 120 days so as not to lose their validity.
During the state of emergency, worker and employer can enter into individual agreements that overlap with the Consolidation of Labor Laws (CLT). However, they must respect the 1988 Constitution.

1- Teleworking
Companies will be able to transfer employees to the teleworking regime.
2- Anticipating holidays
The procedure for individual holidays to be brought forward will become simpler. Employee must be notified 48 hours in advance.

1- Teleworking
Companies will be able to transfer employees to the teleworking regime.
2- Anticipating holidays
Measure applies to proportional vacations, in the case of employees who have not yet worked 12 months.
3- Collective holidays
The collective vacation period can be brought forward without the need to notify unions and the Ministry of Economy.
4- Bank of hours
The employees’ unworked days at that time may count as a bank of hours to be used in favor of companies in the future.
5- Workload and wage reduction
Companies will be able to proportionally reduce up to 50% of wages and working hours by individual agreement.
The minimum wage of a minimum wage and the irreducibility of the hourly wage must be guaranteed.
6- Anticipating holidays
Non-religious holidays can be anticipated, without financial loss, so that the worker stays at home during this time of health crisis.
7- Medical tests
Occupational medical examinations, with the exception of admissions, and periodic training will no longer be mandatory at the moment to avoid overburdening public and private health systems.
8- FGTS
The payment period of the Employees’ Severance Pay Fund (FGTS) is postponed for up to 3 months.
